Agricultural law is not narcotics law

According to FOAG, hemp ceased to fall under agricultural seed legislation on 1 January 2021. This does not generally legalise all cannabis seeds. The Federal Supreme Court addresses seeds for plants capable of at least 1% total THC in the context of narcotics schedules. The plants they can produce and the authorised purpose also matter.

CBD, THC and other requirements

FOPH distinguishes cannabis below and at or above 1% total THC. Below that threshold, food, therapeutic-product and product-safety rules may still apply. Medical cannabis and scientific pilot trials are separate regulated routes, not general access.

No cross-border assurance

Import, shipping, commercial activities and cultivation depend on the country and specific facts. Community registration does not replace a permit. Check current official requirements and, where necessary, obtain qualified advice before acting.
